Te Korowai o Ngāruahine Trust is seeking a dynamic an experienced Kaiwhakahaere Whiwhinga me ngā Kirimana – Procurement & Contract Management Specialist to lead the development of best-practice procurement and contract management across the organisation and its entities.

This is a unique opportunity to shape how we engage suppliers, manage contracts, and deliver value with a forward-looking approach to procurement that strengthens organisational outcomes.

Key Responsibilities:

Establish and embed procurement and contract management frameworks, policies, processes, and controls.
Lead end-to-end procurement activities, including market engagement, sourcing, evaluation, and contract award.
Promote competitive sourcing and tender processes to maximise value, transparency, and fairness.
Develop and manage high-quality contracts, ensuring strong commercial and risk outcomes.
Monitor supplier performance and strengthen vendor management practices.
Provide trusted commercial and procurement advice to Pou, project teams, and leaders.
Build procurement and contract management capability across kaimahi through guidance, tools, and templates.
Introduce data, reporting, and metrics to enable informed decision-making and continuous improvement.
Lead a planned, forward-looking procurement approach aligned to organisational priorities.

Te Korowai o Ngāruahine Trust is seeking a dynamic and experienced Kaiwhakahaere Pūnaha Kaupapa – EPM Lead to establish and lead a centralised Enterprise Project Management Office for our impact investments. This role will strengthen project and programme delivery, embed best-practice governance and frameworks, and ensure initiatives deliver meaningful outcomes for whānau and the Trust.

This is a unique opportunity to shape how Te Korowai plans, coordinates, and delivers programmes and projects, strengthening organisational capability while upholding tikanga and kaupapa Māori values.

Key Responsibilities:

Lead end-to-end programme management for enterprise initiatives, ensuring alignment with organisational strategy, kaupapa Māori values, and whānau outcomes.
Develop and maintain strong relationships with iwi, hapū, community stakeholders, and government agencies supporting programme success and collaboration.

Hundreds of descendants of Taranaki Maunga gathered at Parliament today to witness the second and third readings of the Te Pire Whakatupua Mō Te Kāhui Tupua/Taranaki Maunga Collective Redress Bill. This was a significant day for the eight iwi of Taranaki: Ngāti Tama, Ngāti Mutunga, Taranaki Iwi, Te Ātiawa, Ngāti Maru, Ngāruahine, Ngāti Ruanui and Ngaa Rauru Kiitahi, who represent approximately 60,000 uri (descendants) of Taranaki Maunga and an area of interest encompassing the whole of the Taranaki region.

It has been seven years since the negotiation process began and is the final outstanding historical Treaty of Waitangi claims redress in the Taranaki region. Ngā Iwi o Taranaki Negotiators are pleased to see Te Pire Whakatupua Mō Te Kāhui Tupua passed through the House of Representatives.

“This is an important day for Ngā Iwi o Taranaki as the recognition of our maunga as a legal person, as tūpuna, and as an indivisible and living being is passed into law,” negotiator Jamie Tuuta says.

The negotiation team also acknowledge one of their negotiation team members Ngāruahine Rangatira Tihi (Daisy) Noble (NZOM) who passed away in 2021 and was a strong force in the maunga redress negotiation process.

“Tihi was a staunch advocate for her iwi and her maunga and she didn’t hold back in negotiations when it came to ensuring the health and well-being of our tūpuna," says negotiator Liana Poutu.

Te Pire Whakatupua Mō Te Kāhui Tupua will formally enable the redress arrangements negotiated in Te Ruruku Pūtakerongo/Taranaki Maunga Collective Redress Deed. Taranaki Maunga will become an official name, the Mount Egmont Vesting Act 1978 will be repealed, the Taranaki Māori Trust Board will be formally disestablished, and the Egmont National Park will be renamed Te Papa-Kura-o-Taranaki, meaning ‘the highly regarded and treasured lands of Taranaki’.

The National Park including Taranaki Maunga and the surrounding peaks will be vested in a legal person, named ‘Te Kāhui Tupua’ and will effectively own itself.

A representative entity made up of both Crown and iwi appointees, to be known as Te Tōpuni Kōkōrangi, will be established to act in the best interests of Te Kāhui Tupua. This entity will carry out conservation-related functions for the national park, such as strategy and planning, promoting the health and well-being of Te Kāhui Tupua, and speaking and acting on behalf of Te Kāhui Tupua.

Te Papa-Kura-o-Taranaki will continue to be managed by the Department of Conservation (DOC) and the National Parks Act 1980 (as amended by Te Pire Whakatupua Mō Te Kāhui Tupua) will continue to apply. Any revenue generated through concessions within Te Papa-Kura-o-Taranaki will be applied to work and projects associated with Te Papa-Kura-o-Taranaki.

Youth Offending) Amendment Bill. Our concerns regarding the Bill includes, but is not limited to:

a. Ineffectiveness of Punitive Measures

b. Disproportionate Impact on Rangatahi

c. Breach of Te Tiriti o Waitangi

The Bill perpetuates an approach that focuses on punishment rather than rehabilitation,

undermining efforts to effectively address the underlying factors contributing to youth offending.

We are almost at the end of the Pākeha year and I know we are all looking forward to a well deserved break. Coming off the back of our AGM and an awesome whānau day at Rāwhitiroa pools – we can almost close out the year, however whilst we take our break – the mahi continues in the background.

Over the next few months (Dec 2024 – March 2025), Te Korowai o Ngāruahine will be undertaking the development of a communications and engagement strategy.

We believe that investing in how we communicate and engage with our ‘Ngāruahine ecosystem’ (iwi, hapū, whānau, and uri) has a positive impact on our uri and ensures that we can stay connected to the voice of the people. We are committed to improving and increasing the quality of our models of engagement and the different mechanisms in which we communicate with our people.

Outlined below are the key phases Te Korowai will undertake for the development of the communications and engagement strategy:

· Phase 3: Strategy development

· Phase 4: Tumu Whakarae and Board feedback

· Phase 5: Implementation

Te Korowai o Ngāruahine Trust (‘Te Korowai’) is the Post Settlement Governance Entity (‘PSGE’) for Ngāruahine Iwi. Te Korowai has responsibility of managing and growing the Ngāruahine treaty settlement assets – for the benefit of Ngāruahine uri, whānau, hapū and Iwi. Te Korowai also has the responsibility to ensure an enduring settlement and that Te Tiriti rights of Ngāruahine are upheld by government.
Te Korowai does not have any political affiliations and we will work alongside any government to progress the interests of Ngāruahine. Equally, we have the responsibility of challenging any statutory reforms and policies that conflict with the interests of Ngāruahine.
This submission outlines the general view of Te Korowai as informed by our purpose, strategies, plans and policies – which can be found at can be found on our website www.ngaruahine.iwi.nz.
Te Korowai strongly oppose the Oranga Tamariki (Repeal of section 7AA) Amendment Bill.

E hoki ki te Ūkaipō

Our priority is the well-being of our Ngāruahine tamariki, whānau, hapū and Iwi. We encourage the reconnection of our uri and whānau to their Hapū and Iwi.
We are concerned by the lack of consultation undertaken with Iwi Māori, and the lack of evidence base for this amendment. We are concerned about the removal of key accountability provisions for tamariki Māori. The current disparities for Māori will widen with the repeal of s7AA.
We support the Waitangi Tribunal's findings in their urgent inquiry report (Wai 3350):

The repeal of s7AA is a clear breach of Te Tiriti article 2 guarantee to Māori of Tino rangatiratanga over kāinga
The repeal breaches the principle of partnership and active protection
The repeal of s7AA is rushed and we are prejudiced by this
There has been a failure to fully analyse the downstream effects of the repeal
There is a significant risk of actual harm to vulnerable tamariki

There is no conflict between Te Tiriti and the well-being and best interests of our Tamariki.

We are deeply concerned by the disproportionate targeting of Māori in statutory reform programme under the 100-day plan, and the toxic vitriol and anti-Māori sentiment that it encourages.
We recommend that the repeal of s 7AA should not proceed.

1. Te Korowai o Ngāruahine Trust (Te Korowai) is the Post Settlement Governance Entity established in 2013 as part of the Ngāruahine Settlement process and is the representative body for Ngāruahine iwi.

2. The Ngāruahine area of interest extends from the Taungatara Stream at the northern-most boundary to the Waihi Stream at the southern-most boundary. The area also encompasses Egmont National Park, including te Tupuna Koro o Taranaki (Mount Taranaki) and overlaps with Taranaki Iwi (west), Te Atiawa (north), Ngāti Maru (north-east) and Ngāti Ruanui (east).

3. Te Korowai, as a non-politically affiliated entity, is committed to the protection of the taiao, as our uri are kaitiaki across the Ngāruahine takiwā. Te Korowai has responsibility of ensuring an enduring settlement and that Te Tiriti rights, as well as Iwi and Hapū interests of Ngāruahine are upheld.

4. Taranaki Maunga is considered our tupuna and has borne witness to the historical injustice that has occurred throughout the region. Ngāruahine are bound to our whanaunga Iwi by our common reverence and regard for our tupuna.

5. As well as being of immense spiritual and cultural significance, Taranaki Maunga supports ecosystems and is the source of many of the region’s freshwater bodies. These streams, rivers and groundwaters are essential to support indigenous habitats and species throughout the region.

6. Te Korowai strongly support Te Pire Whakatupua mo Te Kāhui Tupua / Taranaki Maunga Collective Redress Bill and acknowledge the wide support for the Bill that was expressed during the first reading in the House in April this year.

7. The pursuit for the return of our Maunga, confiscated in 1865 under the New Zealand Settlement Act, has been a long standing kaupapa that served as a constant source of sorrow for our uri. To have the Maunga rightfully returned is a positive step toward reconciliation and justice for Ngāruahine.

8. Te Korowai acknowledge the tireless work and significant dedication invested in this Bill by negotiators from both the Crown and Iwi and Hapū members. The negotiations were no small feat and we are grateful to the collective who have progressed this Bill.

9. As the mandated PSGE for Ngāruahine, Te Korowai expect that Ngāruahine reo, kōrero and mātauranga associated with Taranaki Maunga is acknowledged and protected as the intellectual and cultural property of Ngāruahine.

10. As noted in Te Uru Taiao – the Ngāruahine Kaitiaki plan – Te Korowai will identify and promote opportunities to increase awareness and understanding the wider community has concerning the relationship of Ngāruahine to Maunga Taranaki.

11. It is also expected that access and activities upon Taranaki Maunga be recognised as a privilege which Ngāruahine reserves the right to prohibit should the tapu of our Tupuna be transgressed. We look forward to the future kōrero that will ensure these aspirations are realised.

12. Te Korowai recognise that tangata whenua and kaitiaki roles regarding Taranaki Maunga are a common responsibility shared with our whanaunga Iwi.

13. Co-management, between Iwi, Hapū and the Department of Conservation (DoC) is an objective of Te Korowai; as this will ensure that the special relationship and kōrero of Ngāruahine regarding Taranaki Maunga is recognised, strengthened and preserved for future generations.

14. The further assertion of Hapū and Iwi leadership on our Maunga, through the forming of co-governance entities Te Tōpuni Ngarahu and Te Tōpuni Kokorangi offers comfort to Te Korowai also.

15. Te Korowai acknowledges Te Anga Pūtakerongo and He Kawa Tupua and the agreements reached during early negotiations setting the stage for formal redress arrangements for Te Papa-Kura-o Taranaki.

16. Te Korowai celebrates the development of the redress framework He Kawa Tupua, emphasising our ancestral connections and traditional practices as the foundation for peace and cooperation, binding the physical and human landscapes. This cultural foundation being crucial for the redress framework.

17. Te Korowai are reassured that granting Te Kāhui Tupua all the rights, powers, duties, responsibilities, and liabilities of a legal person is the rightful mechanism used to facilitate proper recognition of our Tupuna Maunga.

18. We also acknowledge Clause 19 (e) which places an intergenerational responsibility on Ngā Iwi o Taranaki, the Crown and all the communities of Taranaki to actively protect the health and well-being of Te Kāhui Tupua.

19. We reiterate that the well-being of Te Kāhui Tupua is a fundamental component in the identity, tikanga, reo, and health and well-being of Ngāruahine.

20. Te Korowai are supportive of Te Papa Kura o Taranaki being the official name of the national park and Taranaki Maunga the official name of this important Maunga Tupuna. Restoring our Tupuna Maunga to Taranaki Maunga not only acknowledges the enduring significance of our Maunga, but it also validates the ancestral rights and sovereignty of Ngāruahine alongside our whanaunga Iwi.

21. We are also reassured that the names of four Tūpuna Maunga within Te Papakura-o-Taranaki will also have their ancestral names officially recognised – Pouākai, Patuhā, Kaitake, and Panitahi.

22. It is uplifting to know that the ingoa Panitahi, the Ngāruahine peak, also known as Rehua and Te Iringa, will be restored under this Bill. This marks a shift away from colonial naming conventions of the past.

23. Te Korowai supports Ngā Pou Whakatupua. Ngā Pou Whakatupua represents the intrinsic values of Te Kāhui Tupua, reflecting the cultural, spiritual, ancestral, and historical relationship between Ngāruahine, our whanaunga Iwi and Te Kāhui Tupua.

24. Ngā Pou Whakatupua embodies ancestral knowledge, supports the lands and people of Taranaki, and requires an intergenerational commitment from Te Korowai, Ngāruahine, our whanaunga Iwi, the Crown, and all Taranaki communities to protect its health and well-being for future generations.

25. Te Korowai are honoured to express our support for this Bill. Anticipating its enactment into law, we eagerly await the further collaboration that Te Korowai will have with our whanaungā Iwi and the Crown.

Tēnei matou, ko ngā manu hiakai, e hiakai ana i te miro o te matauranga – koia te hua o te wānanga nei.

Continuing on our Pā based Board hui, we were at Te Aroha o Tītokowaru on Friday 19th. He mihi tēnei ki a Ngāti Manuhiakai, ki ngā komiti o te Hapū me te Pā hoki.

A key whakaaro that fell out of the hui was hiakai , particularly the insatiable hunger and curiosity that drives wānanga and strong decision making. This is reflected in the future focused joint wānanga sessions between Te Korowai Board and the leadership team, and the full day of governance training on Saturday 20th.

Ngāti Manuhiakai

We took the opportunity to hear from Ngāti Manuhiakai about their priorities. We acknowledged the two years of delays in responding to tono from Ngāti Manuhiakai, and the Board made a commitment to making a decision over the next quarter in relation to their tono.

Tiriti Claims Policy

We approved the new Tiriti claims policy. The policy introduces a decision-making framework to consider whether to escalate a claim to the Waitangi Tribunal (or any of the other tribunals or courts) regarding Ngāruahine rights and interests.

Ongoing compliance

To ensure we model ngā mātāpono, we also approved other policies and guidelines:

Protected disclosures (whistleblowing) policy which encourages a speak up culture at Te Korowai and protects those who do so
Representation policy which facilitates and encourages our people and our interests in local, regional, national and international appointments
Standing order guidelines which details the procedural expectations of the Board and sub-committee hui.

Te Kīwai Mauī

We received our quarterly update from Te Kīwai Mauī, this included progress on our priority projects:

Te Rere o Kapuni has faced a series of delays over the last couple of years, however, as we lead up to the final stages – there will be more information regarding opportunities for uri.
The Whakaahurangi, Kāinga and Project Tūkau business cases are in development and due midyear. Keep an eye out for upcoming hui.

Submissions

Submissions for the Fast Track Approvals Bill has closed. We held a submission workshop to support uri to formalise their views on the Bill.

We urge you all to put pen to paper to write submissions for upcoming take –Te Pire Whakatupua mō Te Kāhui Tupua Collective Redress Bill (the “Maunga Settlement Bill”) which closes 22 o Haratua and the Tiriti

Principles Bill which will go before select committee later this year.

We’ll keep you posted with that date as it comes to hand.

Wānanga – business model and engagement

The Board and leadership team came together to wānanga our business model and engagement. Whilst Te Korowai has strong strategies, this workshop ensured that our business model achieves those strategies and maximises benefits. Often, PSGEs fall into a space of working year by year or being output orientated. This wānanga made us reflect on how we use data analysis to monitor our performance, drive good decisions and how we can be tactful moving forward to maximise benefits for Ngāhuahine in the future.

Equally, we did a deep dive into engagement and how we prioritised engagement. We are overwhelmed by different rōpū and the pressure to engage. What planning can we put in place to ensure we aren’t distracted and that we stay focused on engagement with those who we serve – Ngāruahine.

The Board stayed overnight at Te Aroha Marae and together with Te Kīwai Mauī welcomed Institute of Directors facilitator Susan Huria, no Ngāi Tahu me Ngāi Tuahuriri, to deliver governance essentials training to Trustees, Directors and kaimahi. This was an excellent opportunity for whanaungatanga between the boards and to build on our understanding of governance best practice within a Group structure.

1. Te Korowai o Ngāruahine Trust (Te Korowai) is the Post Settlement Governance Entity (PSGE) for Ngāruahine Iwi. Te Korowai has responsibility of managing and growing the Ngāruahine treaty settlement assets – for the benefit of Ngāruahine uri, whānau, hapū and Iwi. Te Korowai also has the responsibility to ensure an enduring settlement and that Te Tiriti rights of Ngāruahine are upheld by government.

2. This submission outlines the general view of Te Korowai as informed by our purpose, strategy and policies – which can be found at can be found on our website www.ngaruahine.iwi.nz

3. Te Korowai does not have any political affiliations and we will work alongside any government to progress the interests of Ngāruahine. Equally, we have the responsibility of challenging any statutory reforms and policies that conflict with the interests of Ngāruahine.

4. On 9 April 2024, Ngāruahine, along with the other seven iwi that surround Maunga Taranaki, celebrated the unanimous support from members of Parliament for the first reading of Te Pire Whakatupua mō Te Kāhui Tupua/Taranaki Maunga Collective Redress Bill.

5. Now at the final stages of the collective Maunga settlement, we are simultaneously faced with a suite of reform that compromises the rights and interests of Ngāruahine. Te Korowai, as the responsible PSGE for Ngāruahine, is opposed to the Fast Track Approvals Bill in its current form.

Ngāruahine Settlement

6. The Ngāruahine Deed of Settlement (DoS) has a mechanism to participate directly in the decision-making processes of the Council and to contribute directly to a wide range of the Council’s policy, regulatory and advocacy functions2. This provides for Iwi representation on the following two standing committees of the Taranaki Regional Council:

a) The Policy and Planning Committee.

b) The Operations and Regulatory Committee.

7. The purpose of this representation provisions is to enable Ngāruahine to participate in the consenting, policy and plan making processes.

8. The Crown has therefore agreed, with the support of the regional council, to provide redress to Ngāruahine that reflects this strong relationship and provides Ngāruahine with a kaitiaki role. The Crown also acknowledges the role of Ngāruahine as kaitiaki over their area of interest and the adjacent coastal marine area (kaitiaki area).

9. Clause 6 of the Fast Track Approvals Bill only provides for all persons exercising functions, powers, and duties under the (proposed) Act must act in a manner that is consistent with:

a) the obligations arising under existing Treaty settlements; and

b) customary rights recognised under –

i. the Marine and Coastal Area (Takutai Moana) Act 2011:

ii. the NHNP Act.

10. However, Treaty rights and interests extend beyond these selective obligations and include the principles of Te Tiriti o Waitangi as determined by the Courts and the Waitangi Tribunal.

11. In addition to the RMA, many other Acts related to the resource management system contain Treaty clauses to varying degrees such as the Conservation Act 1987, Exclusive Economic Zone and Continental Shelf (Environmental Effects) Act 2012, Heritage New Zealand Pouhere Taonga Act 2014, and Crown Minerals Act 1991.

12. Of particular concern is the requirement for Expert Panels to give greater weight to the purpose of the Fast Track Approvals Bill rather than the purpose of the above existing Acts. In effect, this elevates development over both the protection of the environment and iwi rights and interests.

13. Clause 6 will threaten the working relationship that the Crown has committed to through the DoS which, as stated specified in points 31, 32 and 33, identifies Ngāruahine as kaitiaki over their area of interest.

14. By excluding iwi from the decision-making processes through this Bill, there is a contradiction between the Crown’s commitment to upholding treaty settlements and the proposed legislation around resource management.

15. We recommend inserting a new Treaty Clause in Part 1

In achieving the purpose of this Act, all persons exercising functions and powers under it, in relation to managing the use, development, and protection of natural and physical resources, shall take into account the principles of the Treaty of Waitangi (Te Tiriti o Waitangi).

16. The Fast track Approvals Bill was developed against a background of continued Crown failure to address Māori rights and interests in freshwater.

17. The now repealed resource management reforms (Three Waters, Natural and Built Environment Act and Spatial Planning Act) kept Iwi and Hapū at the table and meaningfully engaged in a system where decision making on freshwater resources would be shared, collaborative and mutually beneficial.

Incentives for Iwi and Hapū to stay engaged has now been removed and there is potential for increased destruction and degradation of waterways under this proposed pro development legislation.

18. We recommend potential impacts on water bodies and freshwater ecosystems is included as a significant environmental issue under Clause 17 (3) (i) as per the definition identified in section 1 of this submission.

19. The Minister for the Environment has a responsibility to monitor the effect and implementation of the RMA. Other responsibilities include deciding whether to refer matters that are nationally significant to a Board of Inquiry or the Environment Court.

20. Apart from being consulted when joint Ministers are considering referring a project that requires a marine consent under the EEZ Act, the Minister for the Environment will play almost no role in the decision-making process which delivers infrastructure and development projects within New Zealand under the proposed Bill. Worryingly, we will then have a Minister for the Environment who is a passive observer in matters which could have significant adverse impacts on the environment.

We recommend the inclusion of the Minister for the Environment as a joint Minister under this Bill.

Sustainable management and integrated development

21. One issue of concern is climate change mitigation and adaptation. This requires co-ordination and integration across multiple Acts within the resource management system.

22. We support the recommendation made by the Ministry for the Environment to include reference to sustainable management in the Bill, not just development.

23. We therefore recommend that Clause 3 – Purpose is amended to:

The purpose of this Act is to provide a fast-track decision-making process that facilitates the delivery of infrastructure and development projects with significant regional and national benefits while continuing to promote the sustainable management of natural and physical resources.

Clause 17 (3) – Consideration of significant regional or national benefits

24. There is no heirarchy of the ten matters contained in subclause (3) which lists conflicting potential projects such as:

• Clause 17 (3) (f) will support development of natural resources, including minerals and petroleum.

• Clause 17 (3) (g) will support climate change mitigation, including the reduction or removal of greenhouse gas emissions.

25. We recommend the removal of Clause 17 (3) (f) and the weighting of the remaining sub Clauses of 17 (3).

Expert panels and the concentration of power

26. We are concerned by the large amount of Ministerial discretion and decision-making power that will be granted to the joint Ministers by the Fast-track Approvals Bill.

27. This concentration of decision-making power:

• Lacks transparency and accountability.

• Replaces professional decision-making experts with elected politicians.

• Opens up development, and those who are in positions of power, to corruption and exploitation.

28. We recommend the removal of Clause 1(2) (a) of Schedule 3

The lack of a project list – SCHEDULE 2

29. Currently there are no projects listed in the Bill. Ministers will make the final decision on what projects are listed potentially via a supplementary order paper – and potentially after the Select Committee process takes place. This again provides no transparency or opportunity for public scrutiny.

30. We recommend that all projects to be listed in Schedule 2 Part A and Schedule 2 Part B be made public before progressing this Bill further. This allows some measure of public scrutiny and Government transparency on how projects become listed and who lists them.

31. Our concerns around listed projects also centres on the lack of spatial planning at both the national and regional level. We recommend that a national spatial strategy and spatial plans for each region are resourced by Central Government prior to the implementation of any Fast Track Approval legislation in order to ensure development is well thought out, sustainable and futureproofed.

Fast-tracking the Fast-track Bill - The lack of evidence based law making

32. In the normal course of introducing legislation,

a. a Regulatory Impact Statement (RIS) is prepared and published at the time the relevant Bill is introduced to Parliament or a regulation is gazetted.

33. This is to ensure that the regulatory process is open and transparent and includes:

• a high-level summary of the problem being addressed;

• any options and their associated costs and benefits;

• the consultation undertaken; and

• the proposed arrangements for implementation and review.

34. On the 29th November 2023, Cabinet agreed to ‘streamline’ the process for 100-Day Plan initiatives requiring Regulatory Impact Statements by:

• exempting them from the normal quality assurance process;

• requiring agencies, where the Government is implementing new policy, to complete post-implementation assessments for regulatory proposals.

Treasury and the Ministry for the Environment agreed that an impact analysis would be prepared under these above guidelines.

Ministry for the Environment (MfE)

35. On 1 March 2024, MfE published a deparmental disclosure statement on the Bill to support and enhance Parliamentary and public scrutiny of the Bill3. The disclosure statement noted in regard to the Bill:

• no analysis was available on the size of the potential costs and benefits.

• the Bill amends the jurisdiction of a court or tribunal (including rights to judicial review or rights of appeal).

• the Bill contains provisions that could result in the compulsory acquisition of private property.

• the Bill provides that members of Expert Panels are not liable for anything they do, or omit to do, in good faith in performing or exercising the functions, duties, or powers of the EP.

• environmental considerations will have less weight in the final decision than the purpose of the Bill.

36. On March 7 MfE published its Supplementary Analysis Report on the Treaty Impact Analysis on the Fast Track Approvals Bill 4. The report is a broad analysis of the Treaty impacts of the policy decisions reflected in the Bill due to policy decisions being made separately by delegated Ministers. The report identifies the following broad concerns:

1) the shift in decision making assessment criteria for RMA approvals, placing the new purpose of the Act above Part 2 RMA in terms of the assessment hierarchy;

2) the decision to include no Treaty clause; and no reference to Treaty clauses in existing legislation (for instance RMA, the EEZ Act, the Conservation ACT); and

3) the fact that the Act focuses more on provisions to protect and recognise Treaty settlement and Takutai Moana interests, rather than broader Māori rights and interests.

37. New Zealand Treasury produced a guide in 2017 entitled “Government Expectations for Good Regulatory Practice”5. It sets out the governments expectations that a regulatory system should be an asset for New Zealanders, not a liability. This guide also states that durable outcomes of real value to New Zealanders are more likely when a regulatory system conforms to established legal and constitutional principles and supports compliance with New Zealand’s international and Treaty of Waitangi obligations.

38. Due to the significant impact Fast Track legislation will have, it is recommended to the Environment Select Committee that this Bill to undergo the following standard requirements of quality assurance:

a. A full Regulatory Impact Assessment, including;

i. Identifying and quanitifying the likely costs and benefits of the proposed Bill.

ii. The range of alternative options available for a proposed Fast Track Approvals Bill and their impacts and consequences.

b. A full Treaty Impact Analaysis, inlcuding;

i. A report detailing extensive consultation undertaken with Iwi, Hapū, and Māori organsations, and

ii. The outcomes they are seeking from a Fast Track Approvals Bill and the environmental issues of significance to them.

Lack of consultation

With such a large Bill that impacts resource management processes, we would expect that Government consultation includes ample time for engagement. Positive outcomes for Iwi and hapū can be best attained by early engagement, allowing for adequate review, internal consultation and robust feedback opportunity. This ensures that the concerns, perspectives, and aspirations of Iwi and hapū are not only heard but also integrated into the decision-making process. Moreover, transparency and inclusivity will lead to trust and collaboration between Treaty Partners, paving the way for effective resource management strategies that honour Treaty principles and promote sustainable development.

39. Given the significance of Bill, there was a failure by Government to consult reasonably and in utmost good faith with PSGE’s regarding the development of this Bill. Te Korowai experience of the consultation process included:

a. A letter dated 30 January 2024 outlining a 12 February 2024 deadline for consultation on the Fast-track consenting Bill

b. A request to meet with a Ministry for the Environment lead on 18 January 2024 regarding the Fast-track consenting Bill. We met on 12 February – the consultation cutoff

c. A bulk email invitation to iwi dated 5 February for 12 February – the consultation cut-off date

d. A bulk email invitation to iwi dated 5 February for 12 February – the consultation cut-off date

e. A letter dated 12 February 2024 that included initial feedback regarding the proposed Bill

f. A generic reply to our letter was received on 12 April 2024

g. An Official Information Act request for the list of project entities and the extent of engagement to date

40. We have significant concerns that our poor Government engagement to date is indicative of the consultation under the Bill’s

b. clause 22 (1) (c) Decision to accept application for referral

c. clauses 16 and 14 (3) (i)

41. The requirement to consult with relevant Iwi, Hapū and Treaty settlement entities and customary marine title applicants under clause 16 has no expected outcomes other than to record the engagement and state how it has informed the project.

42. We recommend that Clause 16 – Consultation requirements for applicants for approvals add subclause (3)

(a) An applicant’s engagement must be genuine, meaningful and allow adequate time for response; and

(b) provides each of the groups identified in (1) with the opportunity to define their preferred environmental outcomes.

43. Te Korowai has an ambitious Impact investment strategy. This strategy outlines the priority sectors for investment over the next five years, including:

a. Tourism and hospitality

i. A boutique lodge on Maunga Taranaki due to open Q3 2024

b. Housing

i. A business case for 76 mixed-housing development, six papakāinga feasibility studies, and support for a Hapū based trades training programme.

c. Hapū partnerships and whenua utilisation

i. Six Hapū special purpose vehicles (SPV) to hold and develop deferred selection properties (DSP)

ii. A circulating fund to support the acquisition of further assets and their development by the Hapū SPV

d. Infrastructure

i. An Iwi owned and developed civic development in partnership with Local council

e. Energy sovereignty

i. Initial market research and development for an energy sovereignty strategy

44. We are supportive of regional development generally. However, we are sceptical regarding the economic benefits that are proclaimed by industry, how this is measured and how this is assessed. Our Iwi was promised a lot from the dairy and oil and gas industries – with marginal economic benefits retained within our Ngāruahine rohe. Instead, we have irreparable damage to our taiao and further alienation of our whenua.

45. Te Korowai, like many PSGE, is now able to target impact investments into our rohe. There needs to be consideration surrounding the opportunity cost of large projects and how they may restrict productive or diversified developments in the area – particularly iwi or hapū led developments.

46. If true regional economic growth is to be achieved, a clear criterion with qualifiers under Clause 17 (3) d is required. We also recommend mechanisms to ensure economic benefits remain in the regional economy in which a project is located and operates in. This could include the requirement of local shareholding interests in the project.

47. We are concerned that the Bill will expedite infrastructure and development projects,at the cost of sustainable resource management, environmental protection, and iwi-hapū rights and interests.

48. The content and recommendations of this submission should not be taken as anexpression of consent to anything contained in the Fast Track Approvals Bill.

49. We can all agree improvements are needed in the consent process; however, thisshould be addressed through system improvements and addressing inefficiencies –not through minimising due diligence and quality consultation.

50. Te Korowai, as the responsible PSGE for Ngāruahine, is opposed to the FastTrack Approvals Bill.

We are in an exciting growth and development period.

We are excited to be working on Pupuke te Hihiri, our five year Whai Rawa (Impact Investment) Strategy (2022-2027). Endorsed by Te Korowai o Ngāruahine Trust in March 2023, the purpose of this strategy is to guide Te Korowai Group into investments that will provide a social, cultural, environmental as well as, economic return for the benefit of Ngāruahine.

Since signing the Ngāruahine Iwi historical treaty settlement with the Crown in 2014, we've seen our asset base grow from from $67.5m to $112m ($44.5m increase) for the year ending 31 March 2023. This was achieved through the implementation of a diversified and prudent investment portfolio. To date, these investments can be described as traditionally commercial, whilst being mindful of ethical considerations. This investment growth has meant we are now able to broaden its focus and include impact investments.

Pupuke Te Hihiri is aligned to our overarching strategy Ka Ora Taku Toa and is complimented by a suite of strategies in certain focus areas. This suite of strategies are essential for guiding our core work (investments, Hapū enablement, progressing our treaty settlement arrangements, advocacy and partnerships with community) so that we are intentional, creating the greatest impact and measurable value for our people.

POSITION STATEMENT

This statement relates to the policy agenda by the new coalition government.

General position

The new coalition government, led by National and including Act and NZ First, was formed based on the details in the respective coalition agreements. This policy agenda will have a detrimental impact on Māori and Ngāruahine.

Te Tiriti o Waitangi was between the Crown and Māori. Any interpretation of that has been reinforced to date through the Waitangi Tribunal, Treaty settlement legislation, general legislation and the judicial system. A crude unilateral statutory reform on the Treaty principles will have a detrimental impact on Māori, Iwi, and most pressingly to us, the rights of Ngāruahine uri, whānau, hapū and iwi.

Te Korowai has held a strong, effective and productive relationship with local government over the last three years. Te Korowai has committed to large impact investment projects into South Taranaki that will support local economic growth for the benefit of not only Ngāruahine, but the wider community. This impact investment includes; housing, civic development, tourism infrastructure and hapū development. The recent inclusion of Māori wards has further solidified our relationship with local authorities. We see our relationship with South Taranaki District Council, Stratford District Council and Taranaki Regional Council as successful examples of iwi/council relationships which will contribute to our people living in a thriving environment. The reintroduction of local referendum on Māori wards will have a negative impact on Te Korowai resourcing – impacting our capability and capacity to deliver on local investment.

We have a high level of cynicism and resentment from being used as a political football for subsequent governments, and no material health, social, environmental, or cultural improvements for our Iwi. We are concerned by the disproportionate level and targeting of Māori in the policy agenda which is focused on disestablishment and removal of our rights versus corrective solutions to the, widely agreed, disparities faced by Māori. This reductive approach does not serve Māori and does not serve Aotearoa. It is also contrary to the ‘productive’ and ‘administrative efficiency’ driven rhetoric espoused amongst the three coalition partners. Instead, the result is a continuation of toxic vitriol and anti-Māori sentiment.

Specific position

The policy agenda that negatively impact Māori include, but are not limited to:

Te Aka Whai Ora. Māori Health Authority disestablishment.
Examine the Māori and Pacific Admission Scheme (MAPAS) and Otago equivalent to determine if they are delivering desired outcomes.
Repeal the Smokefree Environments and Regulated Products (Smoked Tobacco) Amendment Act 2022 to remove the requirements for denicotinisation and the reduction in retail outlets.
Remove Section 7AA from the Oranga Tamariki Act 1989.
Remove co-governance from the delivery of public services.
Restore the right to local referendum on the establishment or ongoing use of Māori wards, including requiring a referendum on any wards established without referendum at the next local body elections.
Confirm that the Coalition Government does not recognise the United Nations Declaration on the Rights of Indigenous Peoples (UNDRIP) as having any binding legal effect on New Zealand.
Amend section 58 of the Marine and Coastal Area Act to make clear Parliament’s original intent, in light of the judgment of the Court of Appeal in Whakatōhea Kotahitanga Waka (Edwards) & Ors v Te Kāhui and Whakatōhea Māori Trust Board & Ors [2023] NZCA 504.
Amend the Waitangi Tribunal legislation to refocus the scope, purpose, and nature of its inquiries back to the original intent of that legislation.

Te Korowai o Ngāruahine Trust is seeking an Administration Coordinator to support the implementation of Te Korowai o Ngāruahine procurement strategy, Te Ara Toiroa (pathway to whānau prosperity).

What is Te Ara Toiroa?

Te Ara Toiroa is a targeted pathway and strategy to help lead Ngāruahine uri and whānau towards prosperity. It’s purpose is to build the Ngāruahine economy through our procurement initiatives with Ngāruahine at the helm. Te Ara Toiroa: Ngāruahine Procurement Strategy is our solution. We believe that procurement can create positive socio-economic change for our iwi.

How it works

Our strategic interventions: Matauraura, Te Ara Toiroa and Pupuke Te Hihiri are the pou we have identified to develop a streamlined ‘cradle to grave’ process that ensures our uri do not fall through the ‘career gap’. These interventions create support systems and equitable access to our procurement opportunities for all Ngāruahine uri. The Te Ara Toiroa Implementation Plan will be delivered by the Te Ara Toiroa Delivery Team, and you will play a key role in its establishment.

Ideally, you will have an intimate knowledge or experience of the Iwi and Māori environment that we operate in. You must be extremely confident in your skills. The role focusses on providing all necessary administrative and coordination services to support Te Ara Toiroa Delivery Team. A key part of that initially will be to set up the Iwi business and skills database.

It is important you have the ability to build effective relationships with Hapū and Manawhenua representatives, Iwi and relevant stakeholders, including central and local government agencies.

Key Requirements and Competencies

Proven experience in an Administrative Coordinator role. Providing support to a manager in a large organisation is desirable.
Administration qualifications are a must.
Management skills and Trade qualifications desirable.
Understanding of Te Reo Māori me ōna tikanga - Level 3 and a willingness to extend on your learnings.
Able to work independently.
Solutions focussed.
Quick thinker and team player in a fast-paced environment.
High level of planning and organisational skills.
Relationship management.
Excellent administration and support skills.
Proficiency in Microsoft Office, including Outlook, Word, Excel, and PowerPoint.
Well-developed verbal and written communication skills.
Good knowledge of modern office management systems and procedures.
Minute taking.
Information gathering and analysis skills.
Experience in drafting spreadsheets
